1. Your Acceptance
A. Your use of Homewo Inc.’s products, applications, services, and web sites (referred to collectively as the “Services” in this document and excluding any services provided to you by Homewo under a separate written agreement) is subject to the terms of a legal agreement between you and Homewo. “Homewo” means Homewo Inc., a business incorporated in Illinois that offers Services through the internet and primarily at the Homewo.com web site. By using or visiting the Homewo web site or using Services provided by Homewo in anyway, you signify your agreement to these terms and conditions (the “Terms”). If you do not agree to any of the Terms, you may not use the Services.
B. Though Homewo may attempt to notify you if the Terms are modified or revised, it is your responsibility to periodically review the Terms. Homewo may, in its sole discretion, modify or revise these Terms at any time, and you agree to be bound by such modifications or revisions.
2. Services
A. These Terms apply to all users of the Services, including users who also contribute Content. “Content” is defined as any text, photos, graphics, videos, audios, worksheets and other materials that you may view on, access through, or contribute to the Services.
B. Homewo has not and cannot review all of the Content posted on the Services. The Services may contain links to third-party websites that are not owned or controlled by Homewo. Homewo has no control over, and assumes no responsibility for, the content or practices of any third-party website. In addition, Homewo will not and cannot censor or edit the content of any third-party site. By using the Services, you expressly relieve Homewo from any and all liability arising from your use of any third-party website. Accordingly, be aware when you leave the Services and enter a third-party website.
C. As Homewo cannot review all of the Content posted on the Services, you may find Content posted on the Services to be offensive, indecent, or otherwise objectionable. Content may contain technical inaccuracies, typographical mistakes, or other errors. By using the Services, you expressly relieve Homewo from any and all liability arising from your use of Content posted on the Services.
3. Homewo Accounts and Subdomains
A. In order to access some of the Services, you will need to create an account or subdomain on the Services. You may never use another’s account without permission, and you are solely responsible for the activity that occurs on your account. You must keep your account password secure, and you must notify Homewo immediately of any breach of security or unauthorized use of your account.  You are considered responsible and fully liable for all activities that occur under your account and any other actions taken in connection with your subdomain. Â
B. Homewo accounts and subdomains are intended to be created by or for educators. Accounts and subdomains that are not created for educational purposes, at the sole discretion of Homewo, are subject to immediate termination without warning or notice.
C. Homewo reserves the right to change or remove any Content from the Services that Homewo considers inappropriate, unlawful, or otherwise objectionable. You acknowledge that Homewo may terminate or deny access to the accounts or subdomains of any users on the Services that are found to be in violation of the Terms or otherwise at the sole discretion of Homewo. Â
4. Digital Millennium Copyright Act
A. Homewo recognizes the intellectual property rights of others. Homewo does not condone or permit the distribution of any material or Content that is protected by the copyright, patent, or trademark of any third-party. By using the Services, you agree to not post or make available any such protected Content.
B. If you believe that Content located on or linked to by the Services violates or infringes on your copyright or intellectual property rights, notify Homewo. Homewo will respond to all such notices as required or appropriate by removing the offending or infringing material or disabling all infringing links. In the case of a user who is found, at the discretion of Homewo, to repeatedly use the Services to infringe the copyrights of others, Homewo may deny access to and or terminate the offending user’s account.  In the case of such termination, Homewo will have no obligation to refund any amounts of payments previously paid to Homewo.Â
5. Disclaimer of Warranties
A. Homewo provides the Services “as is”. Though Homewo is committed to keeping the Services operational, Homewo does not express or imply that any or all of the Services will be available to all users at all times. Homewo may attempt to notify users of scheduled downtime, but any or all Services may be temporarily unavailable due to system upgrades, modifications, or any other technical problem without warning or notice to you at any time. By using the Services, you agree to release Homewo from any and all liability arising from interruptions in the Services. Â
B. Homewo seeks to preserve any and all Content posted on the Services that does not violate the Terms; however, Homewo makes no implicit or explicit warranty that any Content posted on the Services is protected against storage failure, data corruption, or erasure. You are responsible for backing up your Content. By adding Content to the Services, you agree to release Homewo from any and all liability arising from the loss of such Content by storage failure, data corruption, erasure, or any other technical malfunction. Â
6. Paid Services
A. Users have the option to subscribe to premium features, such as increased storage capacity or the privilege of disabling advertisements, made available by Homewo through the Services for a fee. Payments will be charged on the day you subscribe and will cover the use of premium features through the length of your subscription as indicated. Premium features will be made available to subscribers after payment has cleared. All fees paid for access to premium features within the Services are nonrefundable.
B. By signing up for premium features made available by Homewo through the Services, you agree to pay the fees indicated. Though fees paid to Homewo for use of premium Services are not refundable, you may choose not to renew your subscription to premium features on the Services at any time during the length of your subscription until the indicated renewal date by following the procedures put in place by the third-party payment processor handling your transactions with Homewo. If you choose not to renew your subscription to premium features on the Services, your access to premium features will be denied beyond the length of your paid subscription and you will not be further billed.
7. Limitation of Liability
In no event shall Homewo, its officers, or its employees be liable to you for any direct, indirect, special, incidental, punitive, or consequential damages whatsoever resulting from any (I) errors, mistakes, or inaccuracies of Content; (II) the cost of procurement or substitute products or services; (III) any unauthorized access to or use of our servers; (IV) any bugs, worms, viruses, Trojan horses, or malicious code which may be transmitted to or through the Services by any third-party; (V)  any loss or damage of any kind incurred as a result of your use of any Content posted on or made available through the Services.
You specifically acknowledge that Homewo shall not be liable for the Content or conduct of any third-party and that the risk of harm or damage from the foregoing rests entirely with you.
The Service is controlled and offered by Homewo from within the United States of America. Homewo makes no representations that the Services are appropriate or available for use in other locations. Those who access or use the Services from other jurisdictions do so at their own volition and are responsible for compliance with local law.
